The Census Bureau is Violating the
Privacy Act of 1974
By Robert Greenslade © Nitwit Press May 03, 2010 During the past few years, I have read numerous comments from individuals who have been threatened by Census workers concerning the American Community Survey, which masquerades as part of the constitutionally mandated enumeration commonly known as the Census. These Census workers, according to reports I read, are attempting to intimidate people with threats of fines and/or jail to get them to answer the survey form questions. Since we can expect the same tactics concerning the Census, a friend asked how I would respond if they phone or show-up at my doorstep. I said my response would be simple. Since the Census Bureau and its workers are citing federal law to intimidate us, I will use a strategy that responds in kind. The Census Bureau, like the Internal Revenue Service (IRS), is required to comply with the Privacy Act of 1974. If you look at page 97 of the 2009 instruction booklet for the 1040 income tax forms, you will find the statement by IRS. Compliance by federal agencies with the Privacy Act is mandatory and the IRS met the requirements to the letter. This takes us to our friends at the Census Bureau. In an overview of the Privacy Act of 1974, 2010 edition, the Department of Justice states that "each agency that maintains a system of records shall," according to Title 5 United States Code § 552a(e)(3): "inform each individual whom it asks to supply information, on the form which it uses to collect the information or on a separate form that can be retained by the individual -- (A) the authority (whether granted by statute, or by executive order of the President) which authorizes the solicitation of the information and whether disclosure of such information is mandatory or voluntary; (B) the principal purpose or purposes for which the information is intended to be used; (C) the routine uses which may be made of the information as published pursuant to paragraph (4)(D) of this subsection; and (D) the effects on him, if any, of not providing all or any part of the requested information. The packet I received for the 2010 Census failed to meet every requirement listed above. If they will not comply in their initial request, it's a pretty good bet they have no intention of complying - period. Thus, the chances of a part time worker complying with these requirements if they phone or come to my home are slim to none. That being said, if I do hear from someone at the Census Bureau I will tell him or her that I have already responded to their 2010 Census questions. In addition, I will tell them that I do not speak to anyone connected to a government agency because they have a track record of distorting the facts. Therefore, put any request in writing over the signature of a supervisor and I will respond. This creates a record and allows me to consult counsel, if necessary. If they do correspond in writing, they will get a letter in return that simply states your 2010 Census packet violated every requirement of the Privacy Act of 1974 (a copy of the above will be attached). This will include a statement concerning the individual who came to my home if they did not comply with the oral interview requirement noted above. My letter will also state that I am under no obligation to respond further until your agency and its employees meet these requirements. Check - your move Census Bureau.
