Medical Panic:
Swine Flu Tremors Ripple Around the World

Governments around the world were on high alert Monday for the possibility of a swine flu pandemic spreading from Mexico, with health officials urging preparedness and public cooperation but also seeking to avert panic. Increased surveillance following scores of deaths in Mexico has detected confirmed or suspected cases of the new virus in the United States and Canada, and as far away as Europe and New Zealand.

The panic codes are all being pushed - and the mob is reacting as expected (and no doubt, desired). Today (Monday) we went to Level 4 - just short of "Pandemic" where there is significant human-to-human transmission, and so far, John Ringo's "The Last Centurion" protocol seems to be adhered to very carefully. A lot of the stories on the news this week are the panic on swine flu - I'm getting 20 or so messages a day.

The Threat

One can determine the character and integrity of individuals and governments by examining the entities they refer to as their enemies. The United States government now says it is threatened by, and will protect itself from, the following: Those who believe in the constraints of constitutional government; those who believe in state sovereignty; a belief in the right to keep and bear arms; those who abhor state sponsored infanticide; those who fear the ramifications of illegal immigration; alleged "white extremists"; the fear of an "economic turndown"; those who oppose state control of their lives and veterans returning from the state’s illegal and immoral wars.

The "unclassified" version of this report is an admission of criminality on the part of the state and the fear of the demand for enforcement of the rule of law by its citizens. What is in the "classified" section is certainly more damning to the state and a stronger admission of criminality and the fear of an informed citizenry, otherwise, why would they hide its content? Olofson machine gun transfer conviction upheld

David R. Olofson's conviction "for knowingly transferring a machinegun in violation of 18 U.S.C. § 922(o)" has been upheld.

A May 1 ruling from the United States Court of Appeals for the Seventh Circuit held on May 1:

In sum, the defendant’s proffered jury instruction was not a correct statement of the law, and the district court properly rejected it. Furthermore, the evidence presented at trial was sufficient to sustain Olofson’s conviction, and 18 U.S.C. §§ 922(o) and 924(a)(2) are not unconstitutionally vague as applied to the facts of this case. In addition, the district court did not abuse its discretion in either excluding the defendant’s firearms expert from the courtroom during the government expert’s testimony or in denying Olofson’s motion to compel the production of evidence he had requested from the government. Accordingly, we AFFIRM Olofson’s conviction.

Earlier today I reported on my WarOnGuns blog that exclusion of expert witness Len Savage from the courtroom during testimony by his government counterpart was held to be "not an abuse of discretion." One of the greatest failings of the Great Society programs of the 1960s was the devastating blow they dealt to low-income African-American families. And it’s no secret how all this happened.

Thanks to President Johnson’s signature legislation, newly-minted social welfare programs provided an array of services and benefits that were designed to help single moms. But these programs proved to afford powerful incentives for women to become pregnant, and then make sure the dad didn’t hang around too long. The effects were devastating as they were dramatic. Within three decades the number of Black families with fathers and mothers at home plummeted from four-fifths to only 38%. (Read the rest here)

It Always Is 1918 at the CDC

One must remember that for many years, the CDC has been creating vast emergency "plans" that are supposed to swing into action the minute that a rumor is afloat that someone, somewhere, has the flu. Politicians and media figures also want a cut of the action and make sure that they keep the issue before us, telling us "what we need to know."

Actually, what we need to know is that government is the last thing we need in our faces if there is a real pandemic. That is because governments played a major role in creating the conditions that turned the "Spanish Flu" situation of 1918 into a world-wide tragedy that led to the death of millions. If government is to trot out its "war emergency" model as the way to "protect" us from the flu, perhaps we need to be reminded of how well that model works – in making sure lots of people become sick and die. SCOTUS upholds FCC on F-bomb

You know, just for sh*ts and grins (whoo, almost missed one there), imagine for a second that the Court looked at such a case and did its job. How long would it have taken to pen this sort of opinion?

There's nothing in the Constitution, anywhere, that accords the United States jurisdiction on the use of language in public discourse. And the First Amendment quite specifically protects speech, even speech which offends others.

Nobody is harmed by this speech; anyone who may be offended by it may quite sensibly turn the tube off and be done with it. What is wrong with the lower courts that you send us this? This?

The FCC is abusing its power. Take care of that, willya, and stop wasting our time and taxpayers' money!

The Fully Informed Jury Association (FIJA) is a nonprofit org dedicated to educating all Americans herded into jury duty about the fact that they absolutely have the right to refuse to convict a fellow citizen whose only "crime" was engaging in some activity that harmed no one. In fact, as a juror you don't have to convict anyone for anything if you think the law is stupid or doesn't apply to the case at hand or the punishment is onerous or for any other reason your conscience dictates.

Doesn't matter that the judge thinks the courtroom is his personal fiefdom and jurors are his personal peasants or the prosecutor wants another belt notch for his mayoral campaign or a cop is willing to lie in the witness box for the back-pat of throwing one more nonviolent rules-breaker into a cage. Secession Is in Our Future

To say governments were formed to protect the rights of men would be historically incorrect. Almost all governments were formed by ruthless men exerting their will over others through the use of force. Some governments, over time, evolved toward the rule of law, perhaps only because their rulers saw that this would sanction their own continued enjoyment of the wealth that they possessed. In some instances, this evolution involved one or more "revolutions" in which those who were governed were able to better establish the rule of law.

The language of the Declaration should not be construed as an argument about the historical origins of government but, rather, as what would be true and just to an enlightened person, namely, that as persons and as communities of persons, we have the right and the duty to alter or abolish governments that become abusive of our rights. U.S. Rationing During World War II

As the United States mobilized for war after mid-1940, the government’s demands for munitions and related resources began to put pressure on certain markets, and soon prices began to rise. In 1941 they rose faster: from December 1940 to December 1941, the producer price index increased by 17 percent, the consumer price index by 10 percent. In response the government imposed a growing number of selective price controls, enforced by the Office of Price Administration and Civilian Supply, an agency created by executive order on April 11, 1941. The Emergency Price Control Act of January 30, 1942, provided a statutory basis for a successor agency, the Office of Price Administration (OPA). Strengthened by later legislation and executive orders, the OPA eventually administered a price-control system that encompassed almost all civilian goods and services. Of all the great things ever said in regard to human freedom, the above quotation makes perhaps the most profound point about the mental state needed to create and preserve a free political state. One can speak of the value of education, virtue, religion, or personal responsibility in the maintenance of a free society. But what is needed most of all is tolerance.

Contrary to how it is typically introduced, however, the concept of tolerance doesn’t mean acceptance of or indifference to any actions or thoughts of others. It means first an identification and self-assuredness about what is right and wrong — and an equal dedication to letting others find that out for themselves.
