Libertarian Commentary on The News 19 - 25 October, 2008

Please, PLEASE let this campaign end soon, so we can figure out how to pick up our shattered lives and businesses and how to survive the next four years of either "maverick" socialism or "change" socialism! (I'm reading Neil's "Forge of the Elders" this week - and the basic scenario of that particular alternate timeline is not at all unlike what we could be heading to: a World Soviet in fact, if not name.)

As I note in the daily comments, this week has NOT been a good one nationally or even locally. I personally have found my frustration level very, very high with government bureaucrats at the state and local level. No matter how nice they are to their kids and dogs, no matter how well they sing in choir, no matter what great neighbors they MAY make, the attitude of more and more government employees is one of extreme, overweening arrogance, treating the rest of us like something nasty you want to scrape off your boots, morally certain and convinced of their utter invincibility and rightness in everything, and certain that anyone who does NOT work for the government (or even only works part time, or in "marginal" occupations like the military) is beneath contempt, dangerous, immoral, unindicted criminals who must be prevented from harming Gaea, animals, children, and other bureaucrats. Casting My Whole Vote

I will not vote in this election.

I will not participate in this distraction and sham, and neither laziness nor apathy is among my reasons behind my choice.

I think most of the possible voting choices are unethical. Specifically, I believe it is unethical to vote to place another human being in a position of power over a peaceful person who cannot opt out of that system if there is a reasonably realistic chance your choice might prevail. I believe it is unethical to vote to steal a peaceful person’s property- be that theft in the form of taxation, eminent domain, zoning, gun control, the drug war, fines or penalties for victimless activities, or any of a bazillion other activities I could list. Mock the Vote

Observing the power of “the myth that says we are governing ourselves,” Lew Rockwell notes that whereas “[k]ings of old would have been overthrown in short order if they had tried to grab 40 percent of people's earnings, or told them how big to make their toilet tanks, or determined how schools taught every subject,” modern Americans “turn a blind eye to petty tyrannies in our midst.” As Bovard comments, it is as if “[b]eing permitted to vote for politicians who enact unjust, oppressive new laws magically converts the stripes on prison shirts into emblems of freedom.”

Wise up, America. There’s nothing special about 50% plus one. Truth and justice cannot be determined by a show of hands. We are not the government. Voting is not a sacrament. And as it stands today, when we only given a choice between two Establishment approved candidates, voting is a joke. (Read the rest here)

Lawsuit Challenging Obama's Qualifications to be President
Dismissed just as Predicted

In a recent article, "Is Obama Ineligible to be President," I predicted, "even if the facts are correct, the judge will rule Mr. Berg lacks standing to bring the case and dismiss it." Late last Friday night, U.S. District Judge R. Barclay Surrick dismissed the case and ruled that until Congress passes a law giving "citizens, voters, or party members" the legal right to "police the Constitution's eligibility requirements for the Presidency, voters do not have standing to bring the sort of challenge that Plaintiff attempts to bring." Berg, who is an attorney and citizen of Pennsylvania, said he plans to file an appeal directly to the United States Supreme Court.

In a press release announcing his decision to appeal Judge Surrick's ruling, Mr. Berg stated:

"This is a question of who has standing to uphold our Constitution. If I don't have standing, if you don't have standing, if your neighbor doesn't have standing to question the eligibility of an individual to be President of the United States - the Commander-in-Chief, the most powerful person in the world - then who does?" British Crackdown Threatens Us All

Dr. Fredrick Toben, an Australian citizen and historical revisionist scholar, was arrested and imprisoned while passing through London’s Heathrow Airport on Oct. 1. He was en route from the U.S. to Dubai. British authorities are trying to enforce an EU warrant issued by the German government that criminalizes anyone who publishes material online “of an anti-Semitic and/or revisionist nature.”

Rev. Ted Pike, a major American pro-First Amendment activist, states in “Toben Grabbed: International Hate Laws Bite Down”1 that “Every American, especially Christians, should protest this outrageous attack on freedom of speech. Although most Americans do not think like Dr. Toben, his arrest is just a taste of what will come—for Americans like you and your family—if we do not defend freedom now.” (Read the rest here)

The Adjutant General of the State of Alabama was unhappy. He didn't like the informal place of this meeting, he didn't like Jack Durer and he didn't like the way events were pushing him.

He was painfully aware that he was a man very much in the middle. He'd had a long conversation two nights ago with the Secretary of Defense of the United States, a conversation he wasn't about to mention to the Governor. The SecDef had made it plain -- the Adjutant General had sworn his first oath to the United States, not to the state of Alabama -- and that in a federal system, it was the nation which came first. Something else was made plain to him -- his Army pension was on the line if he didn't play ball with Washington. Ray Marsh was a long-time friend and philosophically the Adjutant General was right there with the Governor.

But not if he had to work as a greeter at WalMart to pay the bills.

We talked about the City of Cleveland's efforts to "discourage" open carry of firearms--which is legal in Ohio.

We talked about how the police really aren't more trustworthy or law-abiding than gun owners in general.

Now we're going to talk about "hoplophobia," or fear of weapons. You'll note that phobias are generally considered disconnects with reality that impair the ability of their sufferers to enjoy life fully, and if severe enough, require professional intervention and treatment. WASHINGTON—A rebellion is beginning to take place among American conservatives, many of them influential commentators who are denouncing the takeover of the Republican Party by a mixture of anti-intellectual populists and political extremists.

Novelist Christopher Buckley, the son of the founder of modern American conservatism, has endorsed Barack Obama for president. Columnists Kathleen Parker and Peggy Noonan have questioned John McCain’s judgment in picking Sarah Palin as his running mate. Another columnist, David Brooks, has offered a jeremiad against the Republican Party’s anti-intellectual bent.

More poignantly, they all decry what they perceive as a betrayal of conservative principles. The Myth that Laissez Faire Is Responsible for Our Present Crisis

Laissez-faire capitalism has a definite meaning, which is totally ignored, contradicted, and downright defiled by such statements as those quoted above. Laissez-faire capitalism is a politico-economic system based on private ownership of the means of production and in which the powers of the state are limited to the protection of the individual's rights against the initiation of physical force. This protection applies to the initiation of physical force by other private individuals, by foreign governments, and, most importantly, by the individual's own government. This last is accomplished by such means as a written constitution, a system of division of powers and checks and balances, an explicit bill of rights, and eternal vigilance on the part of a citizenry with the right to keep and bear arms. Under laissez-faire capitalism, the state consists essentially just of a police force, law courts, and a national defense establishment, which deter and combat those who initiate the use of physical force. Scotland Community members form action group
Residents say police improperly conducted six home raids in relation to gang investigation

Residents of the Scotland Community in Potomac have formed a community action group and involved the American Civil Liberties Union and NAACP after six neighbors claimed that police inappropriately raided their homes in gang-related SWAT raids last month.
Montgomery County Police have launched an internal review of claims after a local news channel broadcast a story about the raids, according to a spokeswoman for the department.

According to police, officers simultaneously executed six search warrants in Cabin John, Potomac and Germantown Sept. 24 in relation to a burglary in the Scotland neighborhood Aug. 29 in which weapons were used. Members of the 54 Mob, a gang affiliated with the Bloods, were reported to be involved.

The raids included SWAT units, police said, and some of them were "no-knock" – meaning that police were authorized to enter the home without notice. (Read the rest here!)
