It's Time To Break Out The Torches And Pitchforks!

The DOJ's response to Heller vs. DC ought not be surprising. Nor should it be surprising that it came out of a Republican administration.

Let me tell you a little story. Stay with me for a minute. I know someone who works for "The President's Office for Drug Control Policy". This individual (who, make no mistake, is a great guy) had no military or law enforcement experience, but earned his job through connections and patronage. On his first day, he was sworn in as a "Federal Law Enforcement Officer". Now, without any training required, this individual has what amounts to a NATIONAL license to carry a gun. He can carry a concealed weapon in Washington, DC - with no worries about legal problems. His perks don't stop there, however. While he is not paid particularly well, relative to others like him in the private sector, he has better benefits than people making three times what he does in the private sector and free use of government facilities off limits to you and me. He can call upon the full force and power of the federal government to get stuff done - and he has told me that paperwork and regulations that we have to grapple with almost daily, he can simply ignore. He realizes that in '09 he'll likely get tossed out and though he can make a lot more money elsewhere, he really wants to keep his job. When I knew him a decade ago, he was a staunch federalist. He has been turned. This 'affliction' strikes virtually everyone who enters "the system". It's not a Democratic disease, nor is it a Republican one. The system co-opts everybody.

So, here is my point: our federal government is comprised of people who have been given SUPERIOR rights to you and me; and they have power over us that we cannot challenge. Why? Because representatives, senators, secretaries - even Presidents - come and go. But, the bureaucrats, squirreled away in their subterranean fiefdoms, remain. These people are literally in a class by themselves. Thus, anything that could weaken the power of the government, diminish its reach, is viewed - from their perspective - as a threat.

The United States Government cannot abide a Supreme Court decision that opens a path for challenges to "Federal Law". Why, if SCOTUS says that DC was wrong about that, what else might the underclass begin to question? We can't have the people questioning the government! Order must be maintained! WE are in charge!

If I'm exaggerating, it's not by much.

F.V. -you are right on the money. These reprobates disguised as "public servants" are trying to make the public servants to government. Your comments remind me of a quote by James Madison in Federalist No. 57. He said if the spirit of freedom should be "debased to tolerate a law not obligatory on the legislature, as well as on the people, the people will be prepared to tolerate any thing but liberty."

In his 1908 book "Federal Usurpations," Franklin Pierce put his finger on the problem.

"No set of laws, however good, will bring good government unless honestly and intelligently administered, nor unless those responsible for such administration are held strictly accountable at all times for public abuses. The sore spot is right here; do the people really wish good government? Is there sufficient public virtue among our citizens to demand and appreciate good government? If the legislature passes a bad law you can repeal it, if the constitution is defective you can amend it, but if 'the people themselves are lacking in public spirit there is no remedy.'"

"There is no such thing as an individual securing his rights unless he is willing to insist upon them at all times; and there is no such thing as a people securing their rights unless they are ready to fight for them at all times."

"Until [the] spirit of indignation is stirred to action all over the land and the people are ready to fight for the vindication of their rights, there is little hope of effective reforms. We need the spirit of old Peter Muhlenburg, who, in the Revolutionary days, to the astonishment of his congregation, flung aside his surplice, disclosing a Continental uniform, and explained: 'There is a time for all things -- a time to preach and a time to pray; but there is also a time to fight, and that time has come!'"

That time has come again. When are the American people going to stand-up to these people and fight for their liberty?

Mama: Indeed! The only way each individual can claim his or her liberty, however, is to live in such a way that they do not infringe on that same liberty claimed by their neighbor. Far too few people seem to understand this, and so play right into the hands of political manipulation.

We must always remember that the government has only one goal and that is control. Health, safety, security or anything else is simply the excuse for the control of our lives and productivity.

I really appreciate your writings on the Second Amendment and whether it's a collective vs. an individual right. At least one bench of the USSC spelled out exactly what you claim when they found; "the right to keep and bears arms is not a right granted by the Second Amendment, nor is it in any way dependent upon it for its existence".

Those of us who believe that the Second Amendment does PROTECT, and DOES NOT GRANT an individual right to keep and bear arms, would do well to spread your words as far as we can. I agree that we need to move away from arguing only about the verbiage and original intent of the Second Amendment, and widen the debate to the meaning of the constitution and why the Bill of Rights was created.

I thank you for your efforts to educate all of us on this polarizing topic.

You Dear Sir know who & how they are, However Dear Sir, I give up my WONDERFUL DREAM, the Dream of Mutual understanding, Caring, Honesty etc. etc. etc.

Please do believe me it does not matter if being Republican or Democrats, both are the same, due to the ONE & ONLY FACT for them: WHO ARE THE PEOPLE OF AMERICA!!!? as 95% of those R & D do not care at all, as they are having the following objective achieved which : (P P P) : PROFIT, PRIVILEGES& PRESTIGE, the rest of the people can go to hell & you know it is the TRUTH.
