Prosecutorial Misconduct Cannot be Dismissed or Forgotten

Private citizens living in the area where Idaho County Prosecutor Kirk MacGregor abuses his authority -- and wields vindictive power to against honest, law-abiding citizens who refuse to do his bidding -- should not rest easy.

The dismissal of charges of felony perjury against retired nun Carol Asher does not excuse the vindictive and ill-informed actions on the part of MacGregor. His attack on the authority of the jury, on the right of the juror to render a verdict based on conscience, and his malicious back-door tactics to advance his revenge cannot be forgotten by the people who pay his salary: the public.

Now that MacGregor has shown his true stripes (and my apologies to all skunks everywhere) by using his office, a public trust, to advance his agenda to punish conscientious and honest jurors for (a) acknowledging a higher power than the judge or the prosecutor and (b) for refusing to convict when he demands they do so, as well as for (c) having the temerity to use their own brains to do their own thinking, it is time for a concerted effort by the people who pay this miscreant’s salary to put him out of office.

In fact, let’s not stop there: demand the resignation, the removal from office, and vote out of office all those involved in this abuse of office under colour of law which is an obvious parody of our concept of justice. On second thought, let’s begin to encourage everyone to campaign and vote against every incumbent office-holder. When people realize that we will use the system to clean our public offices every election, maybe a few of them will become honest and accountable. Maybe not, but at least we won’t be allowing entrenched villainy, greed and abuses of power to settle comfortably into our statehouses and county offices.

And that’s my two cents worth as a private, liberty-loving citizen of neighboring Montana.
