That omission admitted by lead detective Allen Brocchini, forced under cross-examination by defense attorney Mark Geragos, unraveled the Prosecutions contention that Laci was unaware Scott had purchased the boat. It also made irrelevant the only piece of possible physical evidence, a single hair found on pliers in the boat, possibly belonging to Laci.
That single hair, which has never been proven to be Lacis except by similarity, never was of much value anyway, since most of us husbands have our wifes hairs clinging to us most of the time. Give me a break: They lived together, slept together, washed their clothes together, hugged, kissed and well, you get the picture. The fact a single hair from Laci might have found its way onto Scott, which found its way onto the fishing pliers, is more to be expected rather that incriminating as evidence. But this development in the case places Laci in direct contact with the boat, making the hair even more irrelevant. That leaves the Prosecution with absolutely ZIP for physical evidence in the entire case.
But Brocchinis admission also strongly supports the Defenses contention that police immediately focused on Scott Peterson as a suspect to the blind exclusion of any others, and suggests that the lead detective left exculpatory evidence out of his report for the purpose of framing Scott Peterson for the murder of his wife and unborn son.
How many times have we seen this kind of police misconduct before? The loss of credibility for the Prosecution is palpable, and from this day forward you can be certain every one of those jurors will be questioning the veracity of every other aspect of the Prosecutions case, including everything theyve heard and seen before. I still cannot fathom how the prosecution can drag this case out for five or six months! They dont have a single eyewitness who can claim they saw Scott Peterson threaten Laci, kill Laci, or dispose of her body. Incredibly, and considering the capital murder charges, the prosecution cannot prove how Laci Peterson or unborn son Connor even died! Thats right: The Prosecution cannot prove Laci was murdered. The only thing the Prosecution can prove is that Laci and Connor are dead. Period.
Further, there is no crime scene, no blood, no signs of a struggle, no nothing. The Prosecution has absolutely nothing to present the jury except witnesses and police officers who have and will testify that Scott Peterson lied on some occasions and didnt seem to do what a distraught husband ought to do, whatever that is.
I cant believe how many otherwise rational people think they can determine a persons guilt by how they are supposed to act, based entirely on how they would act under the same circumstances. You cannot impose your own assumed response to a given situation on others, but people judge others by that absurd standard every day. It is a flawed and completely unreliable standard by which to judge others, and unfortunately, people have been executed after being convicted for nothing more.
I will once again state that I take no stand on Scott Petersons guilt or innocence for the simple reason that I just dont know and not one of you readers do either. You have exactly the same complete lack of evidence as I do, and I am ashamed to share the same oxygen and nation with morons like Fox Bill OReilly, who blurt out on national television their belief that Peterson is guilty. There simply isnt a scintilla of evidence to suggest that, and no responsible American citizen would ever vote to convict a person on evidence as vacant as fails to exist in this case.
But it does trouble me that the Stanislaus County DA has forced this case to trial at this time, because this case is headed for a hung jury at best, and an acquittal at worst if Peterson is guilty.
There is no statute of limitations for murder, which means the DA could dismiss charges right now, and reinstate those charges at some time in the future, if solid evidence of Petersons guilt is discovered. Instead, the DA is forcing this trial now, based on specious and subjective evidence, and an acquittal means Peterson can never be tried again even if the most damning of evidence or witnesses were to surface later. This isnt prosecutorial misconduct; its prosecutorial madness, and I predict Peterson will walk whether hes guilty or not. Carl F.
